General

The following applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements:

“Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing English Law.

The following terms and conditions apply only to the supply and delivery of products, services and information from the Hastings Area Chamber of Commerce.

The term ‘Hastings Area Chamber of Commerce’, ‘HACC’, ‘Chamber’ ‘us’ ‘ourselves’ or ‘we’ refers to the Hastings Area Chamber of Commerce whose office is at 3rd Floor, The Palace Workspace, 1-3 Robertson Street, Hastings, East Sussex, TN34 1HN.

The term “Member”, “You” and “Your” refers to you, the person accessing services or products from Hastings Area Chamber of Commerce and accepting the Company’s terms and conditions.

Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Hastings Area Chamber of Commerce is a trading name of Let’s Do Business (South East) Group Ltd, a company registered in England and Wales under company number 07422542 whose registered office is at 7-9 Wellington Square, Hastings, East Sussex, TN34 1PD.

Governing law: If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

Other Applicable Terms and Policies: the following additional terms also apply to the person accessing services, products or information from Hastings Area Chamber of Commerce and accepting the Company’s terms and conditions set out below:

  • Website Terms of Use, which sets out the terms upon which the user may use the Chamber’s website including the use of Cookies
  • Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our website, you consent to such processing and you warrant that all data provided by you is accurate.
  • Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of our website. When using our website, you must comply with the Acceptable Use Policy.
  • Our Terms and Conditions, which set out the terms that apply to membership fees and our cancellation policy for events.

By agreeing to these terms and conditions you are also confirming that the information you have given is true and correct.

Privacy Policy

We are committed to protecting and respecting your privacy.  This policy (together with our terms of use and any other documents referred to on it; sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.  Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

Information We May Collect From You

We may collect and process the following data about you:

  • Information that you provide by filling in forms on our site www.hastingschamber.co.uk (“our site”) or provided electronically or as a hardcopy version. This includes information provided at the time of becoming a member, registering to use our site, posting material or requesting further services. We may also ask you for information when you report a problem with our site or your membership.
  • If you contact us, we may keep a record of that correspondence.
  • We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them.
  • Details of transactions you carry out with us and in the fulfilment of your membership, bookings or arrangements with HACC.
  • Details of your visits to our site including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.
  • Details of your attendance at our events.

IP Addresses

We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual.

Where We Store Your Personal Data

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”), although this is unlikely. It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers, which again is unlikely. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted using SSL technology. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Uses Made of the Information

We use information held about you in the following ways:

  • To ensure that content from our site and printed material is presented in the most effective manner for you and for your computer.
  • To provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes.
  • To carry out our obligations arising from any contracts entered into between you and us.
  • To allow you to participate in interactive features of our service, when you choose to do so.
  • To notify you about changes to our service.

When you become a HACC member, book to attend an event or sign up to receive information, we will add you to our email database so that you can receive our newsletter and other information from us electronically. We take your privacy seriously and under the terms of the Act, will not pass your contact details to a third party, other than as set out in ‘Disclosure of Your Information’ below. You can unsubscribe at any point, but if you are a member, please contact us so we can discuss how we can keep you informed about the benefits of your membership.

If you have not actively provided your consent we may process your personal information for our legitimate business interests.  To contact you in this way, we will have conducted a Legitimate Interest assessment.  We will:

  • Identify a legitimate interest;
  • Show that the processing is necessary to achieve it; and
  • Balance it against the individual’s interests, rights and freedoms

Retention of Your Personal Information

We will retain your personal information as follows:

  • Your current personal information will be retained for as long as you continue to be a member of the Chamber or it is amended or updated by you. Should you notify us of changes to your personal information, we will retain your previous personal information for a maximum period of 12 months, unless you advise us to delete it sooner.
  • Non-members, visitors and guests. We will only retain sufficient information in order to comply with our contractual agreement with you. We will retain your personal information for a maximum period of 12 months, from the date the last product, service or information was provided to you, unless you advise us to delete it sooner.

Disclosure of Your Information

We do not sell, trade or otherwise transfer to outside parties your personally identifiable information.

We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

We may also disclose your personal information to trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential and you have indicated you wish to receive contact from them.

We may also release your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
  • If HACC, or its ultimate parent company, or substantially all of their assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use (see above) or terms and conditions and other agreements; or to protect the rights, property, or safety of HACC, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

If you do not want us to use your personal information for marketing purpose, please indicate your preference via the relevant boxes on any forms you submit when you are providing your contact information. Each and every marketing message we send you will include an appropriate and easy was for your to opt out of receiving further communications by email from us, usually in the form of an ‘unsubscribe’ link.  Alternatively, you can contact us at info@hastingschamber.co.uk with details of the email address you would like to remove.

Your Rights

We will not use your personal data for marketing purposes unless we have received your consent or as otherwise set out in these terms and conditions. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes.

Access to Information

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act.

The act gives you the right to access information held by us about you.  When we receive a request form you in writing, we must give you access to everything we have recorded on you. However, there may be certain aspects we may not be able to share

  • Confidential information that may relate to others
  • If we think that giving you the information may stop us from preventing or detecting a crime
